  1. SCOPE
    These General Terms and Conditions of Business apply to the sale and delivery of goods by the Schauer Winery with its registered office and business address in 8442 Kitzeck, Greith 21. Unless expressly agreed otherwise, our General Terms and Conditions of Business made known to the contractual partner shall apply. The contractual language is German. Place of jurisdiction: Leibnitz
  2. OFFER
    Our offer is subject to change and is only valid while stocks last. Due to the limited quantities of individual goods, a sell-out situation may occur during your online order. In this case, we take the liberty of offering you alternative products. Only our current terms of delivery and payment apply to the delivery. Deviating agreements are only valid if they are confirmed by us in writing.
  3. ORDER
    3.1 The customer's order constitutes an offer. A contract shall only be concluded after acceptance on our part. The customer will be notified of our acceptance by e-mail or by telephone. If we are unable to fulfil the customer's order for any reason, the customer will be informed immediately.
    3.2 The acceptance of the order is subject to delivery possibilities. The Schauer Winery reserves the right to allocate smaller quantities to customers in the event of oversubscription of a product.
  4. PRICE
    4.1 Prices are quoted in euros per item, including all statutory duties and taxes (value added tax), but only refer to the goods themselves and do not include shipping costs. All costs incurred by shipping, including any import or export details, shall be borne by the buyer. The buyer will be invoiced for all delivery costs actually incurred - these will be displayed in the shopping basket when ordering in the online shop after correct selection, and shown in an order confirmation issued by the Schauer Winery. The amounts stated can be unilaterally changed by the Schauer Winery for future contracts at any time. In the event of typing, printing or calculation errors on the website, we are entitled to withdraw from the contract.
    4.2 The prices are based on the costs at the time of the initial price quotation. Should the costs change by the time the buyer places an order, the Schauer Winery shall be entitled to adjust the prices accordingly.
  5. PAYMENT
    5.1 Wiengut Schauer shall retain title to all goods until full payment of the purchase price including ancillary charges.
    5.2 The Schauer Winery accepts payment by credit card as well as immediate bank transfer immediately upon conclusion of the contract or by advance payment. The bank details are as follows: Schauer Winery IBAN: AT77 3810 2001 0400 0493 BIC: RZSTAT2G102 As soon as we have received the confirmation or payment, the order will be sent to the specified delivery address.
  6. DELIVERY
    6.1 The Schauer Winery charges transport costs for each order quantity in addition to the designated prices. The amount of the respective current transport costs will be displayed during the order process as well as in the order confirmation. In the case of delivery of the goods, use and risk shall pass to the buyer at the latest when the goods are handed over to the buyer or the buyer's representative.
    6.2 For deliveries to European countries, the actual delivery costs will be charged - these will be displayed in the shopping cart after correct selection.
    6.3 In the event of a desired delivery to a non-EEA country, the consumer must contact the Schauer Winery directly to request a desired delivery.
    6.4 Delivery shall be made via an express service commissioned by the Schauer Winery at customary business hours. In the event of non-acceptance of ordered goods, the Schauer Winery is entitled to demand compensation for the additional expenses incurred as a result, such as frustrated transport costs. This does not apply if the Schauer Winery does not provide its services in accordance with the contract.
  7. TRANSPORT DAMAGE
    The Schauer Winery guarantees full compensation for damages and impairments that occur during transport under the following conditions: The incoming goods are to be checked and reported immediately for correctness and completeness. Any complaint must be confirmed by the transport company.
  8. WARRANTY
    8.1 Complaints on the basis of statutory warranty claims can be asserted at the following address: Winery Schauer GsbR, Greith 21, 8442 Kitzeck
    8.2 Customary or minor deviations in quality, quantity, colour, size, weight, equipment or design due to technical reasons shall constitute warranty defects or non-performance of the contract.
  9. EDP PROCESSING AND CUSTOMER DATA
    The buyer agrees that the data about him/her stated in the purchase contract and disclosed during registration will be stored and processed in compliance with the Data Protection Act. This data will be used, to the extent necessary in each case, to comply with statutory regulations and to process payment transactions.
  10. YOUTH PROTECTION
    Wine and spirits can only be handed over and delivered to persons over 18 years of age. In order to comply with legal regulations, the Schauer Winery is entitled to hand over goods only after legitimation by an official photo ID. In the event of a justified refusal to hand over the goods, the customer is obliged to pay compensation for the actual damage incurred (e.g. costs of delivery, etc.).
  11. OTHER PROVISIONS
    12.1 If individual provisions of these General Terms and Conditions are invalid, this shall not result in the invalidity of the entire contract. The remaining content of the contract shall remain unchanged.
    12.2 The place of performance shall be the respective registered office. For all legal disputes, the contracting parties shall submit to the district court responsible for the company's registered office, irrespective of the amount in dispute.
    12.3 The contract is subject to Austrian law.
  12. CANCELLATION POLICY
    Consumers have a fourteen-day right of withdrawal.
    13.1 Right of withdrawal: You have the right to withdraw within fourteen days.
    to revoke this contract without stating any reasons. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the goods. In order to exercise your right of withdrawal, you must inform us (Weingut Schauer GesbR, Greith 21, 8442 Kitzeck, Austria, office@weingut-schauer.at, phone: +43 3456 35 21) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an e-mail).
    To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the end of the cancellation period.
    13.2 Consequences of revocation: If you revoke this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we received notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.

    We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
    You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the end of the period of fourteen days.
    You shall bear the direct costs of returning the goods.
    You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing the quality, characteristics and functioning of the goods.
